Key Milestones and Current Focus

I approach every case with dedication and compassion, knowing that elder law often involves emotionally difficult situations. I am driven to secure the best outcomes for my clients, ensuring that their interests are protected with care.

Born and raised in Albuquerque, I earned a bachelor’s degree in History from New Mexico State University and a Juris Doctor from the University of New Mexico with a focus on indigenous legal issues. After law school, I spent two years at Pregenzer Baysinger Wideman & Sale, PC, dedicating my practice to elder law with a focus on estate planning, probate, guardianships, conservatorships, Medicaid planning, and elder law litigation. My experience at PBWS confirmed my commitment to serving disabled and vulnerable adults and helping families navigate long‑term care needs with clarity and stability.

After PBWS, I continued this work at ABQ Elder Law, PC where I expanded my work in Medicaid planning and long‑term care strategies.

I am proud to bring my experience to Daniel T. Montoya Law, LLC, where I will continue to advocate for elders, families, and vulnerable individuals navigating life’s most important transitions.

Experience and Accomplishments

  • Attorney, ABQ Elder Law, P.C. – Continued my elder law practice in guardianships and conservatorships, probate and trust administration, estate planning, and Medicaid planning, with a greater focus on long‑term care strategies and supporting families navigating complex medical and financial challenges.
  • Attorney, Pregenzer Baysinger Wideman & Sale, P.C. – Served as counsel to disabled and vulnerable adults through guardianship and conservatorship appointments, probate and trust administration, estate planning, Medicaid eligibility planning, and litigation involving abuse, neglect, undue influence, and financial exploitation.
  • Board Member, Elder Law Section of the New Mexico Bar Association – Coordinated mixers connecting attorneys and law students to expand interest in elder law, and organized and presented a CLE on the ethical and practical use of AI in legal practice.
  • Clinical Law Student, UNM Economic Justice Legal Clinic – Assisted clients with wills, end‑of‑life documents, medical debt dismissal, navigating eviction proceedings, and name‑change proceedings.
  • Intern, New Mexico Law Offices of the Public Defender – Drafted motions, conducted pretrial interviews, supported attorneys in hearings and sentencings, and completed rapid legal research and interoffice memoranda.
  • Legal Assistant, Robles, Rael & Anaya, P.C. – Drafted pleadings, managed client communication, prepared filings, conducted research, and supported trial preparation for civil litigation matters.
  • Contractor, Cota Holdings LLC & Rootstock LLC – Contributed to tribal economic development initiatives, drafted impact statements and climate adaptation materials, led nonprofit strategic planning, and prepared grant proposals across diverse tribal needs.
  • Volunteer, New Mexico Immigrant Law Center – Supported attorneys assisting clients with U‑Visa asylum applications by transcribing interviews and organizing sensitive case information to expand access to legal services for immigrant families.

Education

University of New Mexico School of Law – J.D., 2023
Served as the Student Articles Editor of the Tribal Law Journal, member of the Historical Preservation Law Society and Native American Law Student Association. Honors include Dean’s List, Honor Roll, and CALI Awards (a prestigious academic distinction awarded to the law student who earns the highest grade in a specific course) in Antitrust Law and the Consumer Law Writing Seminar.

New Mexico State University – B.A. in History, 2018
Developed a strong foundation in historical research and community engagement while living in and becoming deeply connected to Southern New Mexico.
